《關于辦理申請人民法院強制執行國有土地上房屋征收補償決定案件若干問題的規定》

  最高人民法院2012年4月9日上午出臺了《關于辦理申請人民法院強制執行國有土地上房屋征收補償決定案件若干問題的規定》,最高人民法院新聞發言人孫軍工介紹說,這條司法解釋出臺的目的是為了依法正確辦理市縣級人民政府申請人民法院強制執行國有土地上房屋征收補償決定的案件。
  該司法解釋共計11個條文,充分考慮對被征收人合法權益的多重保護,確立“裁執分離”為主導的強制執行方式。就大家最關注的“強制執行”的方式明確規定,人民法院裁定準予執行的,一般由做出征收補償決定的市縣人民政府組織實施,也可以由人民法院執行。同時該司法解釋還明確提出,強制執行申請書應當由申請機關負責人簽名,加蓋申請機關印章并注明日期,而且這個申請應當自被執行人法定起訴期限屆滿之日起三個月內提出。如果逾期申請,除有正當理由之外,人民法院是不予受理的。

The Supreme People’s Court has issued the Provisions on Some Issues Concerning Applying for Enforcing the Order of the People’s Court on the Stateowned Land Acquisition and Compensation on April 12, 2012. Sun Jun, the spokesman of the Supreme People’s Court introduce the purpose of this judicial interpretation is to correctly handle the application for enforcing the order on the state-owned land acquisition and compensation through the people’s court.

This judicial interpretation has a total of 11 articles, give full consideration to multiple protection of the legitimate rights and interests of the expropriated , and establish the mode of separation between judgment and enforcement. Further the judicial interpretation make the methods of enforcement clear which are concerns of everyone. If the people court makes it clear in its order that the order of enforcement is allowed, the people’s government making the order of expropriation and acquisition arrange for enforcement rather than the people’s court.
